Terms & Conditions

Every passenger on board any bus of the Amour Mezam Company Ltd (hereinafter called « The Company ») shall be carried subject to the following terms and conditions which shall form the contract of carriage.

1- Capacity of Bus

The passenger capacity and speed limit of each bus are indicated on the bus. Passengers are advised to insist on compliance by the driver or agents of the company.

2- Information on bus ticket

Every passenger must give full and official information of his/her identity at the time of registration and obtainment of the ticket. Every passenger must produce a valid bus ticket issued by the Company before embarking and no passenger will be allowed to travel in the name of another person or without a valid ticket. Every passenger must while on board carry on him/her valid identity documents. The Company will not be responsible for any loss or inconvenience caused to a passenger who at any official check point by the Police is found to be travelling without valid identity documents.

3- Validity of ticket

The validity of this ticket is 30 days from date of purchase and is subject to the notices and conditions above. The ticket must be retained in a good condition. No refunds will be made in respect of lost, mutilated or stolen tickets.

4- Arrival time of passengers

Passengers must be at the terminal at least thirty (30) minutes before the indicated departure time shown on the ticket. The company shall not be responsible for any loss or inconvenience suffered by any passenger not respecting this time limit.

5- Comportment of passengers on the bus

Passengers are required to behave in a reasonable, sensible and lawful manner on board the bus and are not permitted to smoke on board, have electronic equipment at a high volume, carry on board intoxicating liquor for the purpose of consuming it, enter or remain on the company’s bus when drunk or under the influence of drugs, bring onto the bus or have in their possession when on them any drugs or medical products other than for medical purposes.

6- Change of bus or time of departure

The company reserves the right to refuse entry to or remove from the company’s buses any passenger who is a nuisance or is abusive or threatening any other passenger or staff or who shall appear in the opinion of the driver or official of the Company to be in any breach of the above conditions and any passenger so refused or removed shall not be entitled to any refund or compensation from the Company whatsoever and the Company shall have no liability whatsoever to such passenger.

The company may without notice substitute or alternate carriers or vehicles, and may alter or omit stopping places in case of necessity. Schedules are subject to change without notice. Cancellation or postponement of a trip by the passenger which must be made at least two hours before the time scheduled for the bus to take off shall attract a service charge of 15% of the price of the ticket.

7- Bus stops

Our buses stop only at Amour Mezam Co. Ltd transport terminals and at other designated and authorised bus stops. The driver will at any such stop inform the passengers of the time to be spent at such point and any passenger who chooses to stay longer than the time announced by the driver does so at his/her own risk and the company shall not be liable for any loss or inconvenience caused to a passenger who misses the bus in transit because such passenger did not respect such time limit.

8- Luggage

Neither the Company nor any of its servants, agents or subcontractors are common carriers. Luggage and personal property for carriage will only be accepted on board on the following conditions:

  • The Company reserves the right to refuse trunks or any excessively heavy or bulky articles or any luggage of an objectionable or dangerous nature which have protruding edges which may tear or damage other luggage with which it is packed within the bus.
  • The Company reserves the right to refuse to carry on board any article or luggage whose inspection and verification has been refused by its owner on request by the driver or other authorized employees of the Company in the presence of the passenger if for reason of security the Company considers it reasonable to do so.
  • All passengers must label their luggage clearly with their names, home addresses, telephone numbers and destination and the Company shall not be liable for the loss of any missing luggage which has not been so labelled.
  • It is the responsibility of the passengers that prior to handing over their luggage to the driver, they advice on their precise destination point to ensure that their luggage is properly placed in the appointed part of the bus by the driver or other authorized person.
  • Passengers must not leave their luggage or other articles unattended to in the premises of the company. The company reserves the right to detain, remove and search any item so left in its absolute discretion to have same dealt with in any way by the police or other authority in the interest of safety and the Company shall be under no liability to the passenger for so acting and any costs incurred as a result of such action shall forthwith be paid by the passenger. The Company will not accept unaccompanied luggage for carriage.
  • Passengers are responsible for ensuring that their luggage are properly loaded in the luggage compartments of the bus. The driver or other agent of the company may assist but it is the passenger’s responsibility to see it on and off the bus. Passengers must also look after their luggage at all times including whilst at the bus station and whilst on the bus. Passengers will be responsible for loading and offloading on the bus their luggage weighing more than 20kilos and the Company shall not be liable for any damage caused to such heavy luggage weighing more than 20kilos during loading and off loading.
  • Passengers who pack individual items of high value in their luggage should be aware that they do so at their entire risk and they should ensure that such items are covered by an adequate policy of insurance in the passenger’s name and at the passenger’s cost.   The company’s liability in the event of such luggage containing such valuable items being lost or destroyed or damaged in any way is limited in accordance with the provisions of this contract and under no circumstances shall the company be responsible for compensating the passenger in respect of any loss or damage sustained by the passenger in respect of such high value items being lost or damaged. High value items shall include by way of non exhaustive illustration jewellery, photographic equipment  such as video cameras, hi-fi equipment, computer hardware and software and antiques. All such items are carried on the company’s buses entirely at the passenger’s own risk whether the company is informed or not about such items being put on board.

 

  • Limitation of liability

The company will not be liable for loss or damage to the passenger’s luggage or to any possession of the passenger unless such loss or damage is caused by the negligence on the part of the company, their servants or agents and in any event, the liability of the company under such circumstances irrespective of the aggregate value of the passenger’s luggage shall be limited to 150.000FCFA or its equivalen

9- Monetary items

  • The Company has the possibilities of helping passengers to transfer money in CFA from one bus terminal to the other. Passengers are not allowed to carry on board important sums of money and the company shall not be liable for any loss of money whatsoever if carried on board by a passenger.

  • “Money” for these purposes shall include local and foreign currency, valuable securities such as cheques, money orders, banker’s drafts, premium bonds and certificates.

  • It is recommended that passengers take out insurance to cover their luggage particularly their items of value.

10- Dangerous, illegal or contraband goods

Unforeseen mechanical problems, delays on or closure of service routes due to severe weather, police directions, accidents or other emergencies, acts of war, vandalism, or terrorism, delays due to fire or damage at a coach station, unforeseen traffic delays, industrial action by third parties, problems caused by other customers, the coach being held or delayed by a police officer or government official, other circumstances affecting passenger’s safety, technical difficulties with vehicles etc.

11- Safety of passengers and luggage

The company undertakes to use its best effort to carry the passenger and luggage with reasonable dispatch. The times shown on tickets, timetables or elsewhere are not guaranteed and form no part of this contract.

12- Non waiver of contract

No agent, servant or representative of the company has the authority to alter, modify or waive any of the provisions of the contract. The company reserves the right to refuse carriage of any person who has acquired a ticket in violation of applicable regulations of the company, transport rules and any other applicable regulations. Transportation fare is subject to change without notice.

13- Force majeure

Force majeur means those circumstances for which the company cannot be held liable and which prevent the company from conveying the passenger to his/her ticketed destination in the manner provided for in the contract. Examples of such circumstances are:

  • Unforeseen mechanical problems, delays on or closure of service routes due to severe weather, police directions, accidents or other emergencies, acts of war, vandalism, or terrorism, delays due to fire or damage at a coach station, unforeseen traffic delays, industrial action by third parties, problems caused by other customers, the coach being held or delayed by a police officer or government official, other circumstances affecting passenger’s safety, technical difficulties with vehicles etc.
